NYC HPD Vacate Order: Correction vs. Dismissal

Find the dated HPD dismissal first. Repair work, a filed request, an inspection and the issuing agency's final action are different evidence. Start with the order itself so the agency and order type stay attached to every later paper.

The posting tells you which agency to follow

HPD's Orders page says a posted order names its issuer and reason and bars occupancy until that agency lifts or rescinds it. Read the agency line before searching for a later result. If the issuer is DOB, keep that matter separate. The NYC DOB permit-search guide covers DOB address and permit records, but a permit result is not the vacate order's final action.

Copy the exact order title, date, address and any identifier printed on a page you actually have. Those are descriptors for matching or asking about a record, not a claim that an online form accepts each field. A photograph of the posting can help identify the paper, but the sign's disappearance is not a dated disposition.

The step after repairs is still a request

After correction, HPD describes an owner Dismissal Request, HPD inspection and actual dismissal; the order stays posted and reoccupancy is not allowed until dismissal. Put the completion evidence, request receipt, inspection result and final HPD action on separate dates. If a folder stops at the request or an inspection appointment, write “dismissal not documented here” rather than turning the last available date into approval.

For copies, HPD lists HPDONLINE and Borough Service Centers. The copy is the starting instrument: it tells you what was ordered and by whom. A later disposition needs its own record. Save both versions if one paper refers to an amended order, because the reference must follow the same matter rather than merely the same building.

The order title changes the next question

Do not treat every HPD order as the same form path. The City's descriptions distinguish these cases:

  1. Underlying Conditions order: Separate affidavit and rescission route. Ask which subtype and written rescission correspond to the order in hand.
  2. Commissioner's fire order: Separate dismissal route. Preserve the fire-order reference instead of importing a vacate-order request date.
  3. Vacant Building Information order: Not County Clerk filed. A blank clerk search therefore cannot settle whether that order exists.
  4. Repair/Vacate order: Copy via Borough Service Center. Name that order class when asking for a copy.

This is a document-routing choice, not a determination that any real building qualifies for a particular process. If the title is missing from a cropped image, get the full order before choosing a subtype. Do not infer one from a neighbor's posting, a permit description or a conversation about repairs.

A fictional file with a missing dismissal

Imagine a folder for fictional Building C. An HPD vacate order is dated March 2022. Contractor photographs show repairs in June. A Dismissal Request receipt is dated July, and an August note says the posting was gone. The folder contains no HPD inspection outcome or dismissal. None of these invented dates describes a real property.

The July receipt proves a request was made, not that HPD granted it. The August note describes what someone saw, not why the posting changed. The next targeted question is whether HPD issued an inspection outcome and a dated dismissal or rescission for that particular order. Keep the order number and address together in the question; do not attach a document for another apartment or a differently titled order just because it is newer.

If the missing paper is the order itself, ask for its copy first. If you already have the order but lack the result, ask for the final agency action and its date. These are different gaps, and a response to one need not answer the other.

Keep DOB closeout out of the HPD dismissal box

A DOB signed-off permit or letter of completion belongs to a different record chain; the DOB closeout guide explains those labels. Even where the work concerns the same address, a DOB closeout entry does not identify HPD's order disposition. Match the issuing agency, order class and reference before using any date as the answer.

This guide did not open HPDONLINE, a Borough Service Center file or a property-specific order. No historical coverage floor or copy-delivery time was verified. A missing online hit does not prove no order was issued or dismissed. For a current occupancy question, seek the issuing agency's written status rather than treating repairs or a removed posting as permission.

For the violations behind many vacate orders, see our NYC HPD violations lookup, which covers class A, B and C deadlines and how long 2024 violations stayed open.
